After reviewing evidence – including a videotape of the Novermber 2007 incident, in which Spears allegedly ran over a photographer's foot – the Los Angeles District Attorney's office has announced it will not bring charges against the 26-year-old performer, the Associated Press reports.
According to the D.A. office's report, Spears was "driving at an extremely slow rate of speed and in a straight path" when the photographer was allegedly struck in the midst of a paparazzi swarm. And while the tape does not show the collision, the "only way the victim's foot could have been where the video indicates it to be was by the victim placing it in that location."
The unnamed paparazzo filed a police report in early May 2008 – some six months after the incident – seeking a felony charge against Spears for failing to stop after an accident involving an injury.
"We have no evidence to prove beyond a reasonable doubt that the suspect was aware that the victim's foot had been struck by the car," Deputy District Attorney Joseph Shidler wrote, according to the A.P. "There was much commotion and noise at the time."
